1. Acceptance of Terms
By accessing or using sail.dhfm.in ("the Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Platform. These terms apply to all visitors, users, and other individuals who access the Platform.
These Terms constitute a legally binding agreement between you and sail.dhfm.in, operated from India and governed by Indian law.
2. User Accounts
To access certain features, you must create an account. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activities that occur under your account.
- Providing accurate, current, and complete account information.
- Notifying us immediately of any unauthorized account use.
You must be at least 13 years old to create an account. If you are under 18, you confirm that you have obtained verifiable parental or guardian consent as required under the Digital Personal Data Protection Act 2023. Accounts may not be transferred to another person without our written consent.
Because your display name also forms your public profile URL, changes to it are rate-limited: free members may change their name once every 90 days, and Pro members once every 30 days. This protects shared profile links and prevents handle squatting.
3. User-Submitted Content
By submitting prompts or other content to the Platform, you grant sail.dhfm.in a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote your content within the Platform.
You retain ownership of your content. You represent and warrant that your submissions are original, do not infringe on any third-party intellectual property rights, do not contain unlawful material, and comply with our community guidelines.
We reserve the right to remove any content that violates these Terms or our community guidelines without prior notice. We will notify you of the removal where reasonably practicable.
Saved prompts and boards are personal organisation tools tied to your account. Your boards are private and visible only to you. Saving a prompt does not grant you any ownership of it.
AI-generated content: Content generated with the assistance of AI tools and submitted to the Platform remains your responsibility. You warrant that you have the right to submit such content and that it does not infringe third-party rights.
4. Prohibited Activities
You agree not to use the Platform for:
- Submitting harmful, abusive, hateful, defamatory, obscene, or illegal content, including content that violates the Information Technology Act 2000 and its rules.
- Impersonating another person or entity.
- Spamming, scraping, or automated data collection without our express written permission.
- Attempting to breach the security or integrity of the Platform.
- Uploading malware, viruses, or malicious code.
- Violating any applicable laws or regulations, including Indian laws, the IT Act 2000, the Copyright Act 1957, and the Consumer Protection Act 2019.
- Creating multiple accounts to circumvent suspensions or bans.
- Using the Platform to promote or facilitate unlawful activities.
- Harassing, threatening, or intimidating other users.
- Submitting content that infringes copyright, trademark, or other intellectual property rights of any third party.
5. Intellectual Property
The Platform's design, features, logos, and original content are owned by sail.dhfm.in and protected under the Indian Copyright Act 1957, the Trade Marks Act 1999, and applicable international intellectual property laws. You may not copy, reproduce, or distribute any Platform materials without explicit written permission.
Third-party AI tool names (such as ChatGPT, Claude, Gemini, Midjourney) referenced on the Platform are the trademarks of their respective owners and are used for nominative descriptive purposes only. sail.dhfm.in is not affiliated with, endorsed by, or partnered with any such third party.
6. Payments & Subscriptions
sail.dhfm.in Pro is a monthly auto-renewing subscription processed via Razorpay, a payment gateway regulated by the Reserve Bank of India. By subscribing, you authorise Razorpay to charge your selected payment method on a recurring basis.
All prices are displayed in Indian Rupees (₹) inclusive of applicable taxes unless otherwise stated. We are not responsible for any additional fees your bank or payment provider may charge.
Our refund and cancellation terms are set out in the Refund & Cancellation Policy, which forms part of these Terms.
We reserve the right to change subscription pricing with at least 30 days' notice to existing subscribers. Continued use after the effective date of a price change constitutes acceptance of the new price.
7. Disclaimers & Limitation of Liability
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the service will be uninterrupted, error-free, or completely secure. We are not responsible for the accuracy of user-submitted AI prompts or any results obtained from using them with third-party AI tools.
To the maximum extent permitted by applicable law (including the Consumer Protection Act 2019 and the Information Technology Act 2000), sail.dhfm.in shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, income, profits, or goodwill arising from your use of the Platform.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total amount you have paid to us in the 3 months immediately preceding the event giving rise to the claim, or ₹500, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
8. Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms at our sole discretion. Where feasible, we will provide notice and an opportunity to cure the violation before termination, except where immediate action is required to protect the Platform or other users.
You may delete your account at any time through Dashboard → Security → Delete Account, or by contacting us. Upon deletion, your personal data will be handled in accordance with our Privacy Policy and applicable data retention requirements.
9. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act 2000, the Consumer Protection Act 2019, and the Contract Act 1872.
For consumer disputes (India): You have the right to approach the Consumer Disputes Redressal Commission under the Consumer Protection Act 2019 if you are a consumer as defined under that Act. Nothing in these Terms limits your statutory rights as a consumer under Indian law.
For other disputes: Any dispute arising out of or in connection with these Terms that cannot be resolved through our customer support shall be subject to the exclusive jurisdiction of the courts at Visakhapatnam, Andhra Pradesh, India. Both parties agree to first attempt good-faith resolution through our Contact page before initiating legal proceedings.
For EU/UK users: If you are a consumer located in the European Union or United Kingdom, you may also have the right to pursue dispute resolution through the EU Online Dispute Resolution platform or your local consumer protection body.
10. Consumer Rights (India)
If you are a consumer as defined under the Consumer Protection Act 2019, you have the following statutory rights that these Terms do not and cannot restrict:
- The right to be protected against unfair trade practices.
- The right to be informed about the quality, quantity, potency, purity, standard, and price of services.
- The right to seek redressal against unfair trade practices or restrictive trade practices.
- The right to file a complaint with the Consumer Disputes Redressal Commission.
For consumer complaints, you may contact our Grievance Officer via the Contact page (Subject: "Consumer Complaint"). We will acknowledge within 48 hours and resolve within 30 days.
11. Changes to Terms
We may update these Terms of Service periodically. We will notify registered users of significant changes via email at least 14 days before the changes take effect, where feasible. Continued use of the Platform after the effective date of revised terms constitutes acceptance of the new terms.
If you do not agree to the revised terms, you must stop using the Platform before the effective date and may request account deletion.
